Abstract

The discussed judgement of the Supreme Administrative Court concerns the issue of the admissibility of building an exit onto a public road. The aim of the commentary is to analyse the Court’s position that the provisions of a local development plan cannot prohibit the construction of exits onto public roads, because this is the exclusive competence of the road administrator stipulated by law. This position gives rise to the question whether the location of a permanent exit onto a public road can violate the provisions of the local development plan. The study focuses on the grounds for the Supreme Administrative Court's ruling, which state that the permissibility of building an access road to a public road is decided in each individual case by the public road administrator. The provisions of the local development plan cannot prohibit the construction of exits, as this would lead to a modification of the provisions contained in the Act. The analysis of the Court's position seems to be of significant importance not only to the practice of public administration bodies, but in particular to the science of administrative law. The study was conducted by the dogmatic-legal method based on the analysis of legal provisions using the literature of the subject and case law. The analysis of the Court’s position shows that a ban on the construction of exits from public roads contained in a local development plan would lead to a modification of the provisions of the law, thus going beyond the limits of a municipality’s planning authority, understood as an independent competence to determine the purpose, methods of development and development conditions in the local plan. The plan's provisions regarding the conditions for connecting areas with the external traffic system cannot interfere with the substance of the Public Roads Act, because the law clearly states that the road administrator's duties include, among others, issuing road occupation permits and road exit construction permits, as well as collecting fees and fines, regardless of the specific requirements arising from the local development plan.
