Particularly justified circumstances relating to the family’s situation – as a premise for the applying reductions in the repayment of benefits received unduly

Abstract

In the provisions of several acts relating to various types of financial assistance, the legislator used the same premise for applying reductions in the repayment of benefits received unduly, namely “particularly justified circumstances concerning the family’s situation”. However, the legislator did not specify this concept in any of the legal acts. This article summarizes the provisions of law, the opinions of the representatives of the doctrine and the jurisprudence of administrative courts on the indicated subject. A comprehensive analysis of this issue was used to define this concept and to establish that both the literature and the jurisprudence have the same conclusions regarding this premise for applying reductions in the repayment of benefits received unduly, under various legal acts. These conclusions can be used as guidelines for public administrations.
