The Future of the Code of Canon Law (The Code of John Paul II or Francis?)

Abstract

The subject of the study is the current legislative practice in the Church, which abounds in changes to regulations of the Code of Canon Law and legal acts issued outside of it. The author analyzes the reasons un­derlying the code practice, asking whether the code is an adequate form to express the experience of the legal dimension of the Church. He recognizes the code’s inadequacy and points to other tools that would express the unity of the legal phenomenon in forms appropriate for local communities.
