Legal construction of a biotechnological invention in the view of the premise of inventiveness

Abstract

The subject of the article is the issue of the importance and influence of the inventive step on the patentability of a biotechnological invention. This topic has not been sufficiently discussed in the Polish literature, and its relevance is undoubtedly very high, particularly due to the steadily growing importance of biotechnology in science. The article is an attempt to discuss the validity of using the premise of the inventive step in relation to a biotechnological invention. The methodology used was a dogmatic-legal method in the form of interpretation of the relevant regulations and an analysis of the literature.
