Ius Sacrum in reconstructions of the law of the Twelve Tables

Abstract

After the destruction of the original tables, attempts were made to reconstruct the text of the Law as early as antiquity, but sources from that period have hardly survived. The works of Rivalius and Alexander ab Alexandro cite the text of the Decemviri without using any systematics. Only Oldendorp, Hotomanus, the text found in the Corpus Iuris Civilis (CIC) and then Gothofredus reproduce the correct order of the provisions. In the work by Oldendorp, Hotomanus and in the CIC, the systematics is based on the division into ius sacrum – ius publicum – ius privatum; while Gothofredus took into account the commentary of Gaius, which resulted in the ius sacrum – but only the regulations concerning funeral rites – being placed in Table 10. The question arises as to what the Romans meant by ius sacrum and which of the proposed palingeneses is closest to the mentality of the people of the fifth century BC.
