The history of the Polish energy market and its development towards a new model
Abstract
The energy market, which is a key element of regulation of the state and its economic functioning, has undergone changes in the course of history, which continue to have an impact due to the dynamics of the energy sector. The present article provides an overview of the history of the energy market in Poland, starting from the first legal norms regulating the fundamental principles of electricity trading, through political changes and electrification of Poland, to liberalisation and issues related to the energy transformation. The historical outline is preceded by clarification of terminology, which has made it possible to illustrate the development of the energy market as a continuously evolving system, culminating in the contemporary dual-commodity trading model. The aim of the study is to present the processes affecting the volatility of the energy market and to outline the prospects for further development of the energy market model. The analysis has demonstrated that the energy market and the capacity market function as complementary—albeit fundamentally distinct—components of the energy market framework. It has also led to formulating postulates for introducing changes to the existing law. The research problem is the inappropriate legislative approach to the emerging energy market model, which combines the complexity of the energy and capacity markets. The historical and the dogmatic legal methods were adopted to analyse the evolution of regulations and legal acts; the theoretical legal method was applied to examine legal norms and their significance for the issue discussed; additionally, the functional method was used to evaluate the existing legislation and propose changes.
