Abstract
Gloss to the judgment of the Supreme Administrative Court of 8 February 2023, I OSK 2545/19, provides comments on the interpretation of the substantive and procedural law provisions concerning the legal situation of a spouse and, at the same time, a partner in a civil law partnership formed by the spouses, who has been included in administrative proceedings as a party without their knowledge. These comments are presented against the background of the issue of service and the verification of the decision of the first instance authority by the appointed postal representative, to which the case reviewed in cassation referred. The gloss contains, on the one hand, an approving stance on the Supreme Administrative Court’s settlement by setting aside the judgment of the Voivodeship Administrative Court in Szczecin of 30 May 2019, II SA/Sz 124/19. On the other hand, it presents a critical stance on the justification of the Supreme Administrative Court’s judgment, with regard to the issues highlighted therein. The stance presented in the gloss is based on the formal-dogmatic method.
