Regulatory Excess on Globalized Financial Markets Based on the European Union Example
Abstract
There have been many regulatory changes in the area of the financial markets in the European Union in recent years. On the basis of the conducted analyses, it should be stated that, as a rule, regulatory changes introduced at the EU level should be assessed positively, in particular from the point of view of the purpose they are to serve. On the other hand, it is more difficult to agree that there is a need to adopt so many and so very detailed legal provisions. It is worth noting that in some cases (e.g. rating agencies or alternative investment fund managers), there are regulations relating to entities that so far have not faced such challenges. In other areas (e.g. investment services, capital adequacy, investment funds), the legal regulations have been significantly expanded, causing that the regulated entities have to adapt to new reality. It would be difficult to disagree with the statement that in some cases we face regulatory excess, i.e. specific regulation of certain spheres of activity by the legislator. As a consequence, the new legal provisions may fulfill their risk reduction objective but they also cause disproportionate burdens in many cases, including significant regulatory costs.
