Retributive Punishment and Prerogative of Mercy (Pardon) – Critical Remarks

Abstract
In the article, author points that an institution of pardon (ius agratiandi) is based on two values: retributive justice and mercy. Mercy does not contradict justice, but it stands in coordination with that value. Retribution as a foundation of criminal justice not only does not stand in opposition with mercy, but there is not truly a justified act of mercy (pardon) without the principle of retribution. The article consists of seven parts: I. Introduction; II. Does Mercy Contradict Justice?; III. Coordination of Values; IV. Mercy as a Form of Satisfaction and Gratification of Justice; V. A Danger of Distortions of Mercy; VI. A Loss of an Essence of the Prerogative of Mercy; VII. Summary.
