Legal Person’s Power of Attorney. Selected issues

The purpose of this article is to present legal issues concerning the form of legal person’s
power of attorney. According to the author, from the analysis of the rules of procedure the conclusion shall be drawn that proper authorization of an attorney of a legal person requires an addition of a document showing the full powers of the legal person’s authority. The document showing only the power of attorney is not sufficient. The required form of the document showing the full powers of the legal person’s authority is determined according to art. 68 of the Code of Civil Procedure. This requirement is fulfilled by every official document appropriate to the type of the legal person.
