The matter citizen’s arresting of person

The author presents chosen contexts involved with the matter of persons seize touching merely some problems concerned functioning this penalised means of compulsion. As this means strikes directly in one of most important rights of human being – the right to freedom, rules of usage this means have to be especially scrupulously defined in Polish legislature to didn’t be able to allow on different interpretations. In this paper, differences between institution of citizen’s arresting and institution of arresting under lawful authority were showed. Conditions of acceptance of citizen’s arresting were enumerated and discussed. It turned out that arresting one’s person red-handed of crime or in direct chase, a fear for hiding criminal, impossibility of knowing identity of the culprit – these requirements have got quite extensive meanings. Unfamiliarity these can run to misusing the right to citizen’ or low authorities’ arresting – and in the consequence – cause penal or civil responsibility
