Unincorporated associations and registered associations after May 20, 2016 – how will the amended law affect the said forms of social organizations?

From the perspective of active civil society, initiatives taking the form of associations are an increasingly important issue. Aware of the numerous drawbacks of previous version of the Law on Associations, at long last the legislator decided to carry out a progressive reform by passing The Amending Act of September 25, 2015 (most of the amended provisions came into force on May 20, 2016.). This reform is a long-awaited response to the many problems widely discussed in the doctrine and case law, and requires a comprehensive comment. This article is based on comparison of theoretical and practical aspects of the two variants of non-governmental organizations – unincorporated associations and registered associations. An in-depth analysis of the characteristics of both forms, including the law before and after May 20, 2016, enables the reader to make their own, critical evaluation of the selection of each legal form to arrange a particular social initiative. Elaboration, conducted primarily from the perspective of the changes introduced by the Amending Act, intend to determine the effect of the said reform on citizens involved in the NGO sector as well as an increased interest in setting up unincorporated associations.
