Maternity in the Family and Guardianship Code

and guardianship code includes a regulation regarding descent of child from his mother. Before this legal act, it was accepted a rule “mater semper certa est”, but from the motherhood depends also fatherhood and civil status of child. To settle up the legal situation of each child it has been introduced the regulation nr 619, that “the mother of the child is that woman who gave birth to the child”. The publication brings closer this problem analising if this regulation is sufficient taking into account the norms of the Polish law, artificial procreation and subsitute maternity. Is going to resolve the problem of legal and substitute maternity excluding the last one. Literature of the subject grants this kind of contracts null and valid. Detailed adjustment of the problem needs reflection from legal, religious, ethic and philosophical point of view.
