Analysis of powers and competences of the Ombudsman for Children in the light of the Law of 24 September 2010 on the change of law on the Ombudsman for Children and some other laws.

The aim of this study is to show the new powers acquired by the Ombudsman for Children under the decision of the parliament of 24 September 2010, all new prerogatives will undoubtedly influence the quality and effectiveness of the actions of this body which in the Polish legal system has such a short history. The most important powers include, first of all, the possibility of taking part in the proceedings before the Constitutional Tribunal initiated on the motion of the Ombudsman for Children or in the cases of constitutional appeals if they concern the rights of the child and enabling the Ombudsman to take part in those proceedings. Ombudsman for Children was also empowered to address the Supreme Court with motions in the case of adjudication on the discrepancies between the interpretation of the law in the scope of legal provisions when they concern the rights of the child, and he was also empowered to use the extraordinary measures in the form of cassations and cassation appeal. New powers acquired by the Ombudsman for Children undoubtedly influence the renown of this institution among constitutional bodies of law protection.
