The problem of a contract formation process in the Scottish contract law

Abstract

The following paper presents the subject matter of a contract formation process in the Scottish contract law. The problem of consensus in idem and the nature of legal obligation were pointed out. The analysis of the offer and acceptance process was explained. In the scope of an offer acceptance, different ways of making an offer were presented. Moreover, the problem of an acceptance withdrawal was pointed out. The issue of the battle of forms was explained. The subject matter of instantaneous and delayed communication was presented. In the last part of the paper the importance of the postal rule was pointed out and the problem of that was analysed.
