Legal circulation of Certificate constituting the basis of writing out the marriage certificate

The administrative lane that covers Certificate constituting the basis of writing out the marriage certificate is complicated. Firstly it has to be delivered to clergyman who assists in contracting marriage. He is obligated to write out and sign the document. Then the Certificate has to be signed also by clergyman pointed in Regulation issued by Ministry of Internal Affairs. The base of writing out the Certificate is declaration of will of both spouses about contracting civil marriage in procedure of contracting church marriage. Unfortunately, legal acts do not indicate neither exact moment in time nor the way in which such declaration should be expressed by spouses. As it shows in the practice mentioned declaration is usually taken per facta concludentia what is not the right way. After writing out Certificate clergyman is obligated to deliver it in time admitting of no delay to appropriate manager of the registry office. If manager of the registry office does not receive mentioned Certificate or receives it after right time will not write out certificate of marriage. It means that marriage will not be contracted in Polish law.
