Joint Ownership of Premises by Spouses and the Voting at a General Meeting of Property Owners

The article addresses the issue of voting at a general meeting of property owners, organized as a residential community, by spouses in the matrimonial property regime and owning a portion of the property (dwelling premises). Joint property (also community property) remains the prevailing system in the matrimonial property regime. If the premises, as an exception to the rule of superficies solo cedit, are jointly owned (regardless of the type of ownership), then each owner is at the same time a co-owner of the estate managed by the residential community (Article 3 of the Act on Ownership of Premises) and, by extension, a member of that community. Each residential community member is entitled to attend the meeting of the estate owners. Joint ownership of premises may raise doubts as to the voting on resolutions adopted by the meeting of estate owners, among them the co-owning spouses.
