Implementation of the Right to Free Legal Aid on the Example of Solutions Adopted in Some European Countries
Abstract
The institution of free legal aid is a solution adopted in most countries of modern Europe. The statutory and, in the case of Belgium, also constitutional guarantees, ensure that people in a difficult situation, including financial one, receive help from the state financing the costs of professional legal assistance. The analysis of legal solutions and practice of applying the provision of free legal aid in Germany, France, Belgium, the Netherlands, Sweden and Croatia proves the need to continue to apply and improve the functioning of this institution in every democratic state ruled by law. Despite the differences in individual legal systems, the need to promote the idea of free legal assistance and legal education also in countries where such solutions have not yet been adopted is noteworthy. The aim of the article is to indicate similarities and differences in the adopted solutions in the field of free legal aid on the example of selected European countries.
