Effectiveness Public Procurement of Insurance for Healthcare Institutions
Abstract
The article is an original study dedicated to the efficiency of public procurement in the procedure of awarding insurance contracts for healthcare institutions. The principle of efficiency is a new principle formulated in public procurement law. According to its content, the award of a contract should take place in a manner that ensures the best quality and provides the best results within the resources available. All actions of the Contracting Authority should be carried out through the prism of the general principles of the Public Procurement Law, including the principle of fair competition and equal treatment of contractors, which are the foundation of the principle of efficiency. Efficiency of the procurement is expressed in the preparation of the Analysis of Needs and Requirements of the Procuring Entity. A carefully drafted analysis is the starting point for the proper drafting of the terms and conditions of the contract and for achieving adequate contract efficiency. The contracting authority must also properly estimate the contract and divide it into parts depending on the specifics of the contract, i.e. the types of insurance to be contracted. It is also necessary to choose an appropriate procedure, with negotiated procedures often preferred for contracting insurance services. The aim of the research is to examine the elements of the procedure that directly affect efficiency in public procurement procedures for insurance of healthcare institutions, as well as possible actions to be taken by Contracting Authorities to increase it. The scope of the research includes healthcare institutions and insurers operating on the territory of the Republic of Poland since the commencement of Public Procurement Law of 11 September 2019. The above mentioned subject has not been widely addressed in jurisprudence and doctrine, which positively influences the originality of the results and is of significant cognitive value.
