English Concept of Conspiracy and Personal Variety of Preparation for Crime in Polish Criminal Law – a Comparative Perspective

Abstract
The subject of the study is a description of legal institutions in order to compare the normative shape of conspiracy in the English criminal law and the Polish personal variety figure of preparation for crime in Polish Criminal Code (Article 16 paragraph 1 of the Criminal Code) as normative phenomena that criminalize the conclusion of an agreement to commit a crime. In the first part, the author evokes the genesis of conspiracy, describes its character in current English legislation and indicates its characteristics. The second part describes the Polish construction of crime preparation, with particular emphasis on its current shape in the 1997 Criminal Code. The third – concluding part is devoted to comparing individual structural elements of both institutions with the indication of significant differences and the resulting different criminalization ranges.
