The cognition of the court in the inheritance acquisition confir- mation proceedings - part 1

In this article (parts 1 and 2), issues related to the scope of inheritance acquisition confirmation proceedings will be discussed. Generally speaking, cognition is defined as “case examination; investigation especially by the court”, “judicial consideration of the case, inquiry, examination”. In other words, this article discusses the factual and legal issues that should be considered by the court in such proceedings and reflected in an inheritance decision or in a written statement of reasons, as well as matters that should not be considered by the court.
