Delegated Acts - Analysis of the European Commission's Power to Adopt Them

Abstract
The purpose of this article is to analyze and discuss delegated acts referred to in Article 290 of the Treaty on the Functioning of the European Union (TFEU) which, like the implementing acts referred to in Article 291 TFEU, are non-legislative acts of the European Union (EU). The author focuses on the purpose and procedure for adopting delegated acts, as well as on the powers of the European Commission in relation to the adoption of these acts.
The article also addresses the issue of significant changes in the institutional balance between the European Parliament, the Council of the EU, and the Commission with regard to their functions related to the creation of binding legal norms, which the Treaty of Lisbon brought about by introducing the category of delegated acts and implementing acts into EU law.
The author of the article concludes that the limited influence of the Council of the EU (but also of the Member States) on the shape of delegated acts issued in a less formalized manner undoubtedly causes the Council of the EU to distrust the actions of the Commission. As a result, the EU legislator is much less likely to use the possibility of delegating powers to the Commission to adopt delegated acts. Contrary to expectations, therefore, following the Lisbon Treaty’s entry into force, the European Commission has not strengthened its position in terms of adopting normative acts other than legislative acts, nor has it relieved the EU Council and the European Parliament to the expected extent.
