Abstract

The judgement with commentaries issued by the Supreme Administrative Court of 18 August 2020 (ref. file No. II GSK 30/18) concerns the level of technical qualifications of a candidate for the title of legal counsel. The Court formed a thesis that the said level should be as high as possible in order to maintain the proper per­formance of this profession. Both the thesis and the argumentation leading thereto should be approved. Since activities comprising legal assistance provided by persons exercising the profession of public trust take a variety of forms and cover a wide range of matters, it is necessary to possess appropriate knowledge and skills. The minimum level of qualifications achieved by a candidate and expressed with a positive result of the examination should be tantamount to the fulfilment of all strict requirements by the legal counsel. The vocational examina­tion aims to allow persons who represent a high level of professional preparation to practise as legal counsels, which, in a broader context, constitutes the protection of public interest.
