Gloss to the Judgment of the Supreme Administrative Court of 23 May 2019, II GSK 851/18

Abstract

The judgement with commentaries concerns the risk of confusion. It is one of the essential issues in trademark law. It should be referred to not only in relation to the acquis of the Polish administrative courts, but also to the case-law of the Court of Justice of the European Union. The key rule in the examination of the risk in question is the principle of interdependence of factors that should be taken into account in this respect. One of these factors is the similarity of goods and markings. The court clearly states that it is unacceptable to mix the assessment of the similarity of markings with the assessment of the risk of confusion. On the other hand, a conclusion that the markings are not similar should result in the discontinuation of further examination of the risk of confusion in a given case.
