The Analysis of the CJEU Judgment in Case X v Etat belge C 930/19 – the Role of the Court in Enhancing the Protection for the Victims of Domestic violence

Abstract

The paper presents the approving critical analysis of the judgment in case X v Etat belge C 930/19. In the discussed ruling the Court of Justice of the European Union has interpreted Article 13 of the Citizenship Directive (2004/38) in the light of saving of the right to stay in a host Member State of the family member of the EU citizen who is a third-country national and who was a victim of domestic violence before filing for a divorce. Until the present court opinion, this Article has been deliberated on only once – in the case N.A. In the discussed case The Court has changed its case law and stated that the right to stay of the family member who is non-EU national but a spouse to the EU national and also a victim of domestic violence shall equally include situations when the EU national had left the host Member State but the divorce proceedings have not been initiated yet. This interpretation guarantees the victim the needed protection and is in accordance with Article 1 of the Charter of Fundamental Rights.
