Abstract

An unhealthy diet is one of the six major risk factors contributing to the global burden of non-com­municable diseases (NCDs), which are currently one of the leading causes of excess deaths across the world. Scientific studies are more and more often taking into account the prevention of NCDs using legal instruments, including European Union (EU) law. However, there is some uncertainty regarding the scope of the competen­cies granted to the EU and the possibility of adopting legal solutions to deal with this issue. In view of the above, an analysis of EU competencies has been performed to implement possible instruments to counter NCDs at the EU level. In light of the broad catalogue of areas that the EU can affect and which contribute to the incidence of NCDs in society, as well as a number of horizontal provisions setting out the values that must guide the EU, the EU should, within the framework of its competences, consider fighting against food-borne causes of NCDs.
