Russia’s international responsibility for damages caused by forced transfer of Ukrainian children

Abstract
The article analyses the international responsibility of the Russian Federation for damages caused by the forced transfer of Ukrainian children from occupied territories in the course of the ongoing armed conflict. The aim of the study is to determine whether these actions can qualify as a violation of a state’s obligations under the international law, including as an act of genocide within the meaning of Article 2(e) of the 1948 Convention on the Prevention and Punishment of the Crime of Genocide, and what legal consequences occur if such actions are attributed to a state. The research method is the doctrinal legal method, focusing on analysing the norms of public international law, in particular the principles of state responsibility, and complemented by analysing international case-law and documents of international organisations. The research results indicate that the forced transfer of Ukrainian children by the Russian Federation is a severe violation of international law, which may give rise to international responsibility of a state, including obligations of restitution, compensation and satisfaction. It is legitimate to conclude that if the condition of specific intent is met, these actions may potentially qualify as an act of genocide, with specific legal consequences under international law.
