Professional Secrecy of Legal and Economic Public Trust Professionals in Selected Jurisprudence of the Polish Constitutional Tribunal
Abstract
The article provides a comprehensive analysis of professional secrecy in the context of legal and economic professions of public trust from the perspective of constitutional values. Referring to statutory and professional self-regulatory acts, as well as jurisprudence of the Constitutional Tribunal, the author examines the normative status of professional secrecy as an instrumental institution whose scope and substance are shaped by the legislature. Professional secrecy is not explicitly pointed out in the Constitution as a separate constitutional value, despite of that it plays a critical protective role concerning fundamental individual rights such as privacy, confidentiality of communication, and information autonomy.
