Obligation of Polish citizens to report their place of residence

Abstract

The article “Obligation of Polish citizens to report their place of residence” concentrates on issues included in the Act on Census Records and Identity Cards from 10 April 1974 (Journal of Laws No. 136, item 993 from 2006 as amended), referred to as the Act. Due to a long period of time in which the above-mentioned Act has been binding and the importance the institution of a place of stay – place of permanent residence of physical persons it is essential to consider adjusting statutory solutions to changing social facts. It is necessary to change the Act on Census Records and Identity Cards, which makes balanced and measured changes necessary due to very broad connections of this legal Act with other legal provisions, especially within determination of properties of administration institutions. The publication is not only an analysis of binding legal provisions concerning an obligation to report one’s place of residence. It is also an attempt to present new solutions connected with an everyday functioning of a registering authority. What is meant by new solutions is the fact that they do not eliminate current provisions, which would be unwelcome from the point of view of an efficient functioning of the state, but it adjusts the provisions to numerous regulations of substantive law, for example financial and tax law, labour law and social insurance. The article is about a regulation in force concerning the obligation of physical persons – citizens of the Republic of Poland - to report a place of their residence. It includes basic definitions in this subject and connections with different areas of law, analysis of permanent and temporary registration process as well as reporting a change of address. The final part of the publication consists of a recapitulation of considerations referring to the obligation of Polish citizens to report their place of residence and of conclusions de lege lata and de lege ferenda.
