Amount of Maintenance

Abstract

Basic issues related to the obligation to provide maintenance are regulated by the Family – related Responsibilities and Protection Code. The term “responsibility to provide maintenance” means an obligation to provide means of support not only for juveniles but also for other immediate family members (relatives) who are not able to support themselves. Amount of maintenance is set down individually and depends mainly on the two following factors: reasonable needs of the eligible party and earnings and material capabilities of the obliged party (see Art. 135 of the aforesaid Code). It is worthy to emphasize that both needs of the eligible person and capabilities of the obliged one may change in the course of time and the amount of maintenance may also be adjusted accordingly ( see Art. 138 of the Code).
