The Role of the CJEU in Ensuring Migrants’ Security – Analysis of the Post-Crisis Case-Law

Abstrakt
Artykuł prezentuje wyniki badania orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej w obszarze prawa azylowego i powrotowego, dotyczącego ochrony praw migrantów. Zanalizowane orzecznictwo dotyczy postępowań po eskalacji europejskiego kryzysu migracyjnego w 2015 r. Presentowane studiu, dąży do odpowiedzi na pytanie o możliwość funkcjonowania jurydycznego standardu ochrony prawa do bezpieczeńśtwa migracyjnego. Analiza zawiera również odniesienie do problematyki konieczności zapewnienia bezpieczeństwa procesów migracyjnych i obowiązku zapewnienia ochrony praw podstawowych migrantów.
