Location of religious cemetery on the basis of the Polish law provisions of the spatial planning and land use management

Abstract

Churches and other religious organisations in Poland have the right to possess and establish religious cemeteries, which constitutes one of the methods of conducting their mission. Territory on which the cemetery is to be established, in accordance with the provisions on the spatial planning and land development, has to be intended for this purpose. Establishment of cemeteries, in accordance with the act of the real estate economy, is public purpose. Provisions of the Polish law provide two ways of investment location of the public purpose, namely by a decision on the location of the public purpose investment and in the local spatial management plan. These are completely different methods, conducted under two different procedures. In case of the decision, the authority cannot neither refuse to issue positive decision after satisfaction of certain terms and conditions by the applicant, nor make the decision dependent on fulfilment of the conditions, which are not provided by the law. In the procedure of adoption of the local spatial management plan on the other hand, commune authority, using the so called planning power, has greater freedom in designing areas and investments location. Though establishment of the cemeteries by issuing a decision on the location of the public purpose investment is not consistent with the act on cemeteries and burying the dead, it has been used in practice by a lot of authorities. Despite the lack of legality of this practice, it should be noted that it is not only more favourable to the religious organisations, but also constitutes a better guarantee of the implementation of their rights. The subject of this elaboration is the determination of the issue of the obligatory the local spatial management plan for location of religious cemeteries, evaluation of the current legal status in this area, and the settlement of the issue of the admissibility of the complaint on the inactivity of the authority in case of lack of adoption of local spatial management plan for religious cemetery.
