Religious organisations in Ukraine after the Russian aggression in 2022, and the Act of 2024 on the Protection of the Constitutional Order in the Sphere of Activities of Religious Organisations
Abstract
The primary aim of this paper is to analyse the provisions of the Ukrainian Act of 2024 on the Protection of Constitutional Order in the Sphere of Activities of Religious Organizations, which introduced the concept of foreign religious organisations into the Ukrainian legal order. The act was adopted to protect national and public security and human rights and freedoms. It defined the criteria for qualifying foreign religious organisations as prohibited, outlined the consequences of the introduced bans and established the administrative procedure for dissolving a religious organisation that threatens the security of Ukraine. It also prohibited the use of religious organisations to propagate the ideology of the ‘Russian world,’ which is contrary to the interests of the security and integrity of Ukraine. Russian aggression against Ukraine in 2022 resulted in changes in the law that excluded religious organisations tied to the Russian Federation from the scope of application of the 1991 law on freedom of conscience and religious organisations, which was quite liberal in terms of the registration and operation of religious organisations based outside the territory of Ukraine. New legal regulations were subordinated to the requirements of state security and the protection of public interest and thus introduced justified restrictions regarding the implementation of freedom of conscience and religion.
